In 2011, the Florida Legislature abruptly changed laws regarding sinkholes. The changes permitted insurance companies to provide coverage for “structural damage” instead of “physical damage.” The Legislature then provided a definition of structural damage that insurance companies often believe give them the authority to deny sinkhole claims when they should be extending coverage.
Our attorneys have handled close to, if not more than, a thousand sinkhole cases and are very familiar with the Legislative changes and how those changes may affect your claim. If you are noticing stairstep cracking to the masonry portions of your home, or have noticed cracking drywall or tiles, that may be evidence of differential foundation movement. If you live in Florida, there is a real possibility that that foundational movement is the result of sinkhole activity.
