Construction Defects Lawyer

Construction Defects Lawyer

Construction Defects

A primary focus of our firm is on construction defects.  Although our primary focus is on stucco litigation, we handle all types of construction defects, from roofing to foundation issues.  If your Florida home has a construction defect, whether stucco or foundational, our construction defect lawyers can help.

How Much Do construction Defect Lawyers Cost?

That depends. Many of our cases can be done on a contingency basis, meaning you don’t pay anything unless we win a settlement in or out of court. This fee structure ensures our construction defect lawyers will work hard for your case and that you do not have any more out-of-pocket expenses. For more information, reach out to us today.

Will My Home Warranty Cover Defects?

In a perfect world, your home’s defects should be covered. However, if the warranty company believes it was an installation defect from a contractor, they will resist paying for anything to be fixed. Fortunately, Florida has a process where homeowners can recover for construction defects without an applicable warranty.  We are very familiar with these statutes and can navigate them properly and quickly so that your issues can be resolved as soon as possible.  Do not wait to reach out if you believe you have a construction defect.  Statutes of limitation and repose apply to all construction defect matters.  Please contact us for a free consultation.

Frequent Construction Defects

Roofing Defects

Roofing issues don’t usually show themselves until an extreme event occurs.  Roofs can fail at a moment’s notice, whether it is hail or strong thunderstorms.  We have a network of experts who are very familiar with roofs and can help should the insurance company deny your claim.

Sinkholes

In 2011, the Florida Legislature abruptly changed laws regarding sinkholes.  The changes permitted insurance companies to provide “structural damage” coverage instead of “physical damage.”  The Legislature then provided a definition of structural damage that insurance companies often believe gives them the authority to deny sinkhole claims when they should be extending coverage.

Our attorneys are very familiar with the legislative changes and how those changes may affect your claim.  If you notice stairstep cracking to the masonry portions of your home or have noticed cracking drywall or tiles, that may be evidence of differential foundation movement.  If you live in Florida, there is a real possibility that that foundational movement is the result of sinkhole activity.

Stucco Defects

Many homes in Florida are built with a stucco exterior.  This exterior provides an excellent barrier from the elements when installed correctly. Unfortunately, to install stucco correctly, the builders must be skilled and know the ins and outs.  Unfortunately, there are many stucco contractors that do not do an excellent job of installation, which can cause damage to your home.  This ultimately results in the rusting of lath, the cracking of stucco, and, ultimately, the deterioration of the wood beneath the stucco.

Signs of Stucco Defects

Signs of stucco defects can be:

  • cracking
  • buckling
  • pulling away from the structure (i.e., stucco delimitation)
  • stucco falling off the house
  • discoloration

Our construction defect lawyers have worked closely with engineering professionals, contractors, and home inspectors to learn the ins and outs of stucco litigation.   If your home has construction defects, you might have a case. Give our construction defect lawyers a call today to learn more.
